CROWDCLIX PRIVACY POLICY

CrowdClix has developed a proprietary software platform that, among other things, enables businesses to connect with each other and provide real-time local offers to their customers and clients. The technology enables businesses within the network to thank and reward their customers and clients with opportunities at neighboring establishments. The smart technology also learns from transactions to enhance the applicability of future and additional offers.

Structure of this Policy

This policy describes the types of information we may collect from, or about, Individuals (as that term is described below) and how we collect, use, maintain, protect and disclose that information.

Policy Statement

CrowdClix recognizes and respects the privacy of our clients and the consumers.

We have several different types of clients, including (i) marketing affiliates who provide the CrowdClix platform and service as part of their marketing tools; (ii) reseller affiliates who offer no management services, but who sign up businesses to be part of the CrowdClix network; (iii) group affiliates who have multiple business locations and/or the ability to control other businesses; and (iv) business customers, which are part of the CrowdClix network.

CrowdClix obtains information about consumers, which include individuals who are (i) customers of a particular business or client; (ii) members of a loyalty program; (iii) people who become customers of CrowdClix directly; or (iv) otherwise known to a marketing entity or a CrowdClix affiliate.

CrowdClix recognizes the importance of protecting personal data pertaining to all of CrowdClix’ clients and all of the consumers. For purposes of this policy, we will use the term “Individuals” to refer to all of these people individually and collectively. We will protect Individual information through compliance with this policy.

Rights Under this Policy

All Individuals should read the policy carefully to understand our policies and practices regarding Individual information and how we will treat it. If any Individual does not agree with the policy, the Individual must either (i) send an email to privacy@crowdclix.com stating that the Individual wishes to opt-out of CrowdClix’ use of Individual information; or (ii) follow the process set forth by the business entity (CrowdClix client) who originally collected the information. Unless and until CrowdClix receives notice of an Individual’s opt-out, either directly or from the CrowdClix client, all Individuals (except for EU citizens) hereby consent to the use of Individual information in accordance with this policy. Upon receipt of the opt-out notice, CrowdClix will record in the database that the Individual has opted-out from receiving further marketing campaigns, offers and other communication in the manner and degree as indicated in the notice.

Information Collected

We collect information from a variety of sources. Most of the information comes to us through our clients and the consumers; some information may come from third parties.

We also collect information in a variety of ways, such as:

  • through CrowdClix software, software platforms, and mobile and desktop applications (this includes using the software and applications to transfer data, such as through bulk uploads, data imports and other means);
  • at points of sale; and/or
  • in e-mail, text and other electronic messages.

The information can be collected at different points in time, such as when an Individual:

  • joins, or remains in, a loyalty or membership program;
  • places an order or purchases a product;
  • procures, receives or subscribes to services;
  • fills in a form on a website, which requests personal information;
  • responds to an offer, such as a discount, for products or services;
  • interacts with the CrowdClix platform or software; and/or
  • engages in other activities with our clients.

Depending on how and where the information is obtained, CrowdClix collects some or all of the following types of information about an Individual: 

  • name;
  • telephone number;
  • email address;
  • offers made for products and services;
  • responses to offers made; and/or
  • relationship with clients.

In the future, CrowdClix may collect some or all of the following types of information about an Individual:

  • gender, age and birth date;
  • address;
  • products purchased and occasion type; and/or
  • other information the Individual provides.

Any personal information provided or posted in public forums, such as a message board, chat room, discussion group, user review and rate forum, are not protected by this policy and may be collected, shared and used by CrowdClix or with third parties, including to contact an Individual.

CrowdClix does not currently collect personal information about Individuals when they interact with our website, but we may do so in the future. If we do, we will update this policy with more specific information about website tracking and usage. In the meantime, we do collect non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting non-personally identifying information is to better understand how CrowdClix’ visitors use its website. From time to time, CrowdClix may release non-personally-identifying information in the aggregate, such as by publishing a report on trends in the usage of its website.

"Cookies" and Other Tracking Devices

A "cookie" is a small data file sent to a browser from a web server and stored on the user’s computer. If an Individual – or any person - accesses the CrowdClix software, platform (or website) using a computer, CrowdClix may, in the future, use cookies to enable CrowdClix to provide certain features to the Individual or person. Users who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the CrowdClix software, platform (or website), with the drawback that certain features of the CrowdClix software, platform (or website) may not function properly without the aid of cookies. In the future, CrowdClix may engage third parties to assist in analyzing our business such as Google Analytics to track and report on website traffic. We may provide these third parties non-personal information directly from the cookies to conduct this analysis.

Use of Information Collected

CrowdClix uses the personal information to enable CrowdClix clients to communicate with Individuals, to provide a personalized experience as a purchaser or user of products and services, to inform Individuals about offers, discounts, and other benefits and to otherwise enable Individuals to receive credits, gift certificates, incentives or other marketing campaigns.

CrowdClix does not provide the personal information to third parties including, but not limited to, those who share or rent information for direct marketing purposes.

CrowdClix may disclose personal information as may be required by law, in response to legal processes and law enforcement requests and as necessary or appropriate, in CrowdClix’ view.

CrowdClix may also aggregate information about Individuals and/or their response to, or use of, marketing campaigns and offers. CrowdClix may supply aggregated information to its clients for business purposes, including evaluating the effectiveness of marketing campaigns and offers.

The information and lists collected by a CrowdClix client may be updated and/or synched on a schedule provided by CrowdClix, such as at midnight each day. CrowdClix does not own, manage, or create the data, information and lists provided by the clients. Similarly, CrowdClix does not create or participate in the creation of any marketing campaign, offer, or other communication to Individuals. As such, Individuals must address questions and concerns about their data collection and usage to the CrowdClix clients that collected or used the information in the creation or dissemination of any marketing campaign or other offer or communication.

Multiple Sources

CrowdClix may combine information we receive from different sources. For example, if an Individual is a member of two separate loyalty programs that are both clients of CrowdClix, we may combine the information into one comprehensive database (or other technological storage device). CrowdClix may then use the combined information to enhance and personalize an Individual’s experience and to communicate with the Individual in accordance with this privacy policy. In the event an Individual is unsubscribed from one client of CrowdClix, but not all clients of CrowdClix, the Individual will remain in the CrowdClix database and may continue to receive offers.

Security

CrowdClix uses commercially reasonable efforts to protect all personal information, such as in the following ways:

  • Encryption - Encryption technologies protect the information by scrambling it as it is sent from one computer or device to another
  • System monitoring - Regularly reviewing activity logs allows CrowdClix to identify potential problems. CrowdClix also has systems in place to automatically block and help prevent unauthorized access to information. We also review our information collection, storage and processing practices, including physical security measures, to guard against unauthorized access to systems.
  • Patches - CrowdClix updates its systems at routine intervals to use current security technology.
  • Limited Access – CrowdClix restricts access to personal information to those people who need to know that information in order to conduct CrowdClix’ business.
  • Security Measures for Storage – CrowdClix uses only those hosting providers that meet security requirements necessary to protect the information.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat Individuals’ information, we will place a notice on the CrowdClix website or in another easily identifiable location. The date the privacy policy was put into effect, or last revised, will remain at the bottom of the page.

Age Restrictions

CrowdClix does not knowingly collect, maintain or disclose personal information from or about people under the age of eighteen.

EU Citizens

The collection, storage, modification, deletion and use of information pertaining to EU citizens is not governed by this policy. Instead, information pertaining to EU citizens is governed by policies and procedures that comply with the General Data Protection Regulation.
